[Protest of RFP Issued by CIA]
Highlights
A firm protested under a Central Intelligence Agency (CIA) solicitation, contending that: (1) since the required services had previously been acquired on a small business set-aside basis, CIA was required by Defense Acquisition Regulations (DAR) to set aside this procurement; and (2) CIA improperly combined refuse collection and janitorial services under the same procurement. The General Services Administration (GSA) had previously acquired such services on a set-aside basis for CIA under an interagency agreement. GAO held that: (1) while CIA is not subject to the DAR, it has a policy of following DAR whenever possible; (2) CIA was not required to set aside the procurement because the services were previously acquired by GSA, not CIA; and (3) the protester did not demonstrate that the CIA decision to combine refuse collection and janitorial services lacked a reasonable basis. Accordingly, the protest was denied.
