[Protest of DOE Failure To Solicit Bid]

A firm protested the Department of Energy's failure to solicit a bid from the firm under a procurement, contending that Energy deliberately precluded the protester from competition. GAO held that the protester was debarred from Government contracting because of labor standards violations and, therefore, had no legitimate interest in the procurement. Accordingly, the protest was dismissed.
