[Protest of Failure To Receive GSA Solicitation]

A firm protested its failure to receive a General Services Administration (GSA) solicitation which sought offers leading to the award of multiple-award Federal Supply Schedule contracts, even though GSA knew of the protester's desire to receive a new schedule contract. The protester stated that the needs of the user agencies would not be served adequately if it did not receive a new schedule contract. GAO will not recommend resolicitation when a prospective offerer does not receive a copy of a Federal Supply Schedule solicitation unless there is a showing that GSA intended to exclude the protester from competition, which the protester failed to allege. Since the protester failed to establish any basis for GAO to recommend corrective action and had received constructive notice of the solicitation and its closing date in the Commerce Business Daily, GAO denied the protest.
