The Defense Security Assistance Agency requested a decision concerning its authority to obligate Special Defense Acquisition funds under the first continuing resolution for fiscal year (FY) 1986. GAO held that: (1) the funding provision was not a ceiling, but an authorization of the lump sum available for Special Defense Acquisition Fund (SDAF) obligations; (2) there were no directions or limitations as to how the funds should be applied; (3) although statutes did not prohibit the obligation of SDAF funds under an initial, short-term continuing resolution, the agency was unable to obligate funds in its revolving fund for SDAF purposes; and (4) the funding provision in the FY 1985 appropriations act was within the scope of the FY 1986 continuing resolution. Accordingly, the agency erroneously restricted the obligation of SDAF funds while the FY 1986 continuing resolution was in effect.
