[Claim for Interest on Late Payment Under DLA Contract]

Highlights

A firm claimed interest on a late payment made under a contract administered by the Defense Logistics Agency. The payment had been made late due to an administrative error. The Prompt Payment Act provides for the payment of interest where a Government agency does not pay the contractor by the required payment date. However, all claims against the Government relating to a contract must be processed under the Contract Disputes Act which requires that such claims be settled by the agency or the U.S. Claims Court, not GAO. Accordingly, the claim was dismissed.
