A firm protested the language of a provision in a solicitation issued by the Forest Service, contending that the Forest Service improperly intended to construe the provision to permit it to discharge or discipline contractor personnel indiscriminately. The Forest Service contended that the provision would allow it to forbid the use of personnel or facilities that were not in compliance with Federal regulations. GAO held that the protest was not timely because it was not filed within 10 days of initial adverse agency action. Accordingly, the protest was dismissed.
