[Request for Reconsideration]

A firm requested reconsideration of a decision which dismissed as untimely its protest against the National Aeronautics and Space Administration's (NASA) failure to request a wage rate determination for inclusion in a solicitation. NASA stated that the protester had filed a claim regarding the matter in a U.S. district court. GAO will not decide protests where the material issues are pending before a court of competent jurisdiction unless the court expresses an interest in such a decision. Since no such interest was expressed in this case, the request for reconsideration was denied.
