A firm appealed a settlement action by the Claims Group which disallowed its claim for payment for machinery repairs at an Army installation. In its appeal, the claimant asserted that it performed the repairs in response to the Army's request and that its invoice showed that the machinery had to be repaired because it was not functioning properly. The Army maintained that its personnel never requested the services. GAO held that the claimant did not meet its burden of proving that the Army requested the services. Further, GAO found no evidence that the repairs were essential or that the Government received any actual benefit from them. Accordingly, the settlement action was affirmed.
