[Protest Against Small Business Size Standard Classification in Solicitation]
Highlights
A firm protested an amended small business size standard classification contained in a solicitation issued by the Navy for transportation operation and maintenance services. The protester contended that the contract should be classified as a service contract and that the applicable size standard should have been what it was prior to the amendment. The determination of the product or service classification and the size standard to be used for a specific procurement is made by the contracting officer with the right of appeal to the Small Business Administration (SBA). The SBA determination of any size classification is conclusive and, therefore, GAO does not consider such matters. Accordingly, the protest was dismissed.
