A firm protested a contract award issued by the U.S. Immigration and Naturalization Service under a request for proposals for alien identification cards. The protester challenged the award on the basis of four alleged improprieties. Subsequent to filing this protest with GAO, the protester also filed suit in a U.S. district court, requesting injunctive relief pending a GAO decision on the protest. GAO stated that the court's adjudication on the merits of a complaint presenting the same issues as a pending protest preclude GAO from considering the protest. Accordingly, the protest was dismissed.
