[Claim for Court Leave]

The Library of Congress requested an advance decision as to whether a Library employee was entitled to court leave in connection with his appearance in court pursuant to a summons for a traffic violation. Regulations provide that an employee is entitled to leave without loss of pay when, in response to a summons in connection with a judicial proceeding, he serves as a juror or as a witness when the Federal Government, District of Columbia, or a State or local government is a party to the proceeding. GAO maintained that these regulations do not extend to an employee who is the defendant in a case. Accordingly, the employee is not entitled to court leave.
