GAO reviewed a claim for attorney fees for representation of a federal employee whose claim for backpay and restoration of leave was allowed in a prior decision. GAO had held that the Department of the Army committed an unjustified and unwarranted personnel action following the denial of an agency-filed application for disability retirement. Accordingly, GAO granted the employee's claim for backpay and restoration of leave. Following the decision, the employee's attorney filed a claim for his fees. GAO held that reasonable attorney fees might be paid under statutory law and implementing regulations since payment was warranted in the interest of justice. GAO reduced the rate, following criteria established by the Merit Systems Protection Board, to be consistent with rates charged by other attorneys in the area. Accordingly, the voucher, if otherwise correct, may be submitted for payment.
