A firm protested the award of a contract by the Department of Defense Joint Cruise Missiles Project Office under a request for proposals. The contract was to design, develop, test, and qualify an improved rocket-motor assembly for the Tomahawk Cruise Missile. The protester contended that its proposal was not evaluated fairly and that the contract violated applicable legislation. Subsequently, the protester filed a complaint in court regarding the same matter seeking injunctive relief and a declaratory judgment. GAO does not consider protests where the material issues involved are before a court of competent jurisdiction and the court has not expressed an interest in receiving a GAO decision. Accordingly, the protest was dismissed.
