Protest of Agency Determination That Firm Was Not Qualified To Compete

A firm protested a determination that its sample videotape production was not technically acceptable and, consequently, that the firm was not qualified to participate in the uniform system for producing videotapes for the Government. This negative determination was not referred to the Small Business Administration (SBA) for consideration as the protester requested. Such determinations must be referred to SBA under the certificate of competency program. The protest was sustained.
