Protest Concerning Award of Concession Contract

A firm protested a requirement in an Army solicitation that the awardee of a food services contract provide a $10,000 security deposit to the Post Restaurant Fund. The Fund is a nonappropriated fund activity over which GAO has no authority to render a decision. Furthermore, the protest was untimely since it concerned solicitation deficiencies and was received after bid opening. The protest was dismissed.
