Late Bid Receipt Resulting From Severe Snowstorm

A bidder protested the Army's refusal to consider its bid, which was received after the time specified in the invitation for bids. The protester stated that the bid was sent by regular mail with time to arrive prior to bid opening, but that the bid was late due to a severe snowstorm which stopped mail delivery for several days. A bidder who selected other than registered or certified mail when mailing bids assumed the risk of late delivery. Therefore, the late bid sent by regular mail was not considered even though the late receipt resulted from unforeseen severe weather conditions. The protest was denied.
