Highlights

A decision was requested with regard to an employee who began working about 6 weeks prior to the discovery that she had not completed the necessary documents before beginning employment. The employee may be considered a de facto employee since she performed her duties in good faith, and she may be compensated for her service during the de facto period. Since de facto employees do not earn leave, however, she may not claim sick leave for the de facto period.
