Request for Reconsideration of Bid Rejection

A firm requested a reconsideration of a decision which denied its protest of a contract award to any bidder other than itself. The firm, as the second low bidder, had contended that the awardee was neither responsible nor responsive. It had been held that the contract had been properly awarded to the lowest, responsible, and responsive bidder. In its request for reconsideration, the firm contended that the procuring agency deliberately modified an earlier interpretation of the invitation for bids (IFB) in order to deprive it of an award, and that GAO ignored the agency's modification of the IFB interpretation in its earlier decision. It was held that this allegation was not supported by the record, and since the firm merely restated its original arguments without demonstrating errors of fact or law, the previous decision was affirmed.
