Propriety of Withholding Retirement Pay To Satisfy Judgment

The propriety of withholding retirement pay to satisfy a consent judgement against a retired Air Force member was questioned. Since there is no expressed authority for withholding pay to satisfy a judgement for recovery of penalties, the right of setoff cannot be applied to the member's retirement pay.
