Application of Buy American Act to Leases

A protester contended that the Buy American Act differential should be applied only to purchases of equipment and questioned the manner in which the differential was applied to a lease. The Buy American Act applies to leases as well as purchases. However, since the solicitation was found to have other defects, the contract should be terminated for the convenience of the Government when an adequate substitute has been provided.
