Funding of Grant for Contract Award to Nonresponsive Bidder

The Urban Mass Transportation Administration requested a decision regarding the propriety of funding a purchase by the grantee pursuant to a capital facilities grant. Although the grantor believed that the grantee awarded a contract to a nonresponsive bidder in violation of terms of the grant, funding may be supplied since the problem resulted from ambiguous specifications imposed by the grantor, and the grantee acted in good faith.
