Highlights

A decision was requested as to whether an employee was entitled to overtime compensation for travel time under the Fair Labor Standards Act (FLSA). Under the FLSA, a nonexempt employee must be compensated at overtime rates for work which exceeds 40 hours in a week. Since the employee traveled away from his station on behalf of his employing agency, he is entitled to compensation for the excess of his time spent in travel to the temporary duty station.
