The protester alleged that the low bidder was not a small business and that waiver of first article testing concerning the awardee was improper. The protest concerning size status of the awardee was not filed with the contracting officer in a timely manner, and small business size status questions are not reviewed by GAO. The determination of the eligibility of the low bidder for waiver of first article testing was not disturbed since there was no clear showing of arbitrary or capricious action.
