GAO upheld its prior decision that the bidder was entitled to relief for a mistake in bid that had been brought to the attention of the Federal Highway Administration after bid opening, but before award of contract. The bidder submitted evidence which could have reasonably supported its mistake claim, but the agency denied its request for withdrawal because the evidence was not clear and convincing. Because of doubt concerning the bid, the agency should have referred the matter to GAO for determination.
