Highlights

The legal sufficiency and overall efficiency of a contract for pipeline transportation services was questioned. The contract does not involve a normal tender of freight, but the government may negotiate a contract under the Armed Services Procurement Regulations. However, unless the basic procurement document is the bill of lading or a similar document, a bilateral contract should have been negotiated.
