A former member of the U.S. Army appealed the denial of waiver of his indebtedness to the United States. No request for waiver of this debt was received in the proper office within 3 years of the discovery of the erroneous payment. Requests to the service correction boards for correction of records to authorize the payment did not constitute a request for waiver. A member who does not complete his term of enlistment is required to refund the unearned portion of the bonus. A member who resigns while indebted to the United States must make payment from his current pay. Unpaid amounts remaining after active duty ends may be collected from later payments of any nature due the individual from his service.
