Beneficiary of Unpaid Pay, DOD Military Pay and Allowance Committee Action No. 527

In this decision, requested by the Assistant Secretary of Defense (Comptroller), the word "person," as used in 10 U.S.C. 2771(a), interpreted to include a legal entity other than a natural person. Therefore, an Army member's designation of the U.S. Soldiers' Home as beneficiary for arrears of retired pay due at his death is a valid designation. The Soldiers' Home's claim, which was previously denied by GAO, is allowed.
