Proper Computation of Retirement Pay for Military Officer

Capt. M. V. Starr, Finance Officer, USAF, requested a decision on the proper rate of basic pay to be used in computing an officer's retirement pay. He was returned to active duty in August 1974 for one day from a temporary disabled retired status on which he had been placed in January 1971. His retirement pay should be computed on rates applicable in August 1974, not January 1971, as defined in referenced U.S. Code.
