Qualification as Surviving Spouse of Army Member for Entitlement to Survivors' Benefits

A decision was requested concerning payment of Survivor Benefit Plan (SBP) annuities to Mrs Virgie Lee Cowan, who prior to her husband's death had obtained a divorce, which was later set aside by a court on grounds of fraud. As widow of the deceased Sergeant, Mrs. Cowan qualifies to receive SBP annuities.
