Protest Involving Improper Use of Proprietary Data

A company protested award of a contract, alleging that the awardee's bid was based on proprietary information. The rights of the protester with regard to proprietary data do not warrant GAO consideration, and the Government will not disturb an ongoing procurement where the matter of proprietary data is in litigation.
