Highlights

The protester appealed a denial of his claim for a retroactive temporary promotion. To the extent that the employee performed duties on the detail before the higher grade position had been classified, the claim could not be paid as an employee cannot be promoted to an unclassified position. The employee could be awarded a temporary promotion and backpay for the period from the first day following the completion of 6 months after the position was reclassified until the termination of the detail.
