Reimbursement of Loan Origination Fee

An employee submitted a claim for reimbursement of a loan origination fee paid to secure a mortgage for the purchase of a residence incident to his transfer to a new official duty station. The fact that the employee may have been incorrectly advised by the lending institution that the service charge or loan origination fee was not a finance charge provided no basis for reimbursement of the fee since such payment was expressly precluded by Federal regulations.
