A company protested the proposed award of a contract under a grant to a foreign government financed by the Agency for International Development (AID), contending that it was responsive to the tender, and, if strict standards were applied, the proposed awardee was nonresponsive. Such grants are not subject to rules applicable to Federal procurements. Under conditions of this case in which all tenders were nonresponsive and prompt award was required, AID may approve the grantee's selection of a nonresponsive tender which will best serve its needs if the award price is reasonable.
