Reformation of Contract Incident to Mistake Alleged Prior to Award

The contractor requested reformation of its contract based on a mistake in bid alleged prior to the award of the contract. The contract was awarded subject to the mistake alleged prior to the award, and the contractor's evidence left little doubt as to the existence, nature, and amount of the mistake (including the markup not claimed until after award). The reformation of the contract to reflect the error was approved, and the upward price adjustment was not limited to the amount of the error claimed prior to the award.
