Claim for Per Diem While Attending Training Course

A federal employee requested reconsideration of a settlement disallowing his claim for per diem at the rate of $25 per day for temporary duty performed at the Naval Post Graduate School. The employee claimed that he accepted the travel advance based on a per diem rate of $25 in good faith and that neither he nor his command were aware that a lesser per diem rate of $8.50 applied to assignment at the school. The claim was not allowed since the travel orders prescribed per diem at the rate set by the Joint Travel Regulations, and the employee was charged with knowledge of the applicable laws and regulations.
