Reconsideration of Request for Waiver of Indebtedness

A former military member requested reconsideration of a settlement denying his request for waiver of an indebtedness which resulted from an overpayment of pay and allowances he received during a period of excess leave. The member, who used his leave at nearly the same rate as it accrued over the 2 years of his service, then took 47 days' consecutive leave. He did not verify his leave status through appropriate administrative channels when his leave balance erroneously reflected an increasing amount of available leave rather than a negative balance. The charge against him for the excess leave used was not waived since the employee should have realized that he had used excess leave and that he had been erroneously overpaid yet made no effort to correct the error.
