Protest Alleging Ambiguity in Solicitation Specification

The protesters, who did not submit bids, alleged that solicitation specifications were unduly restrictive of competition. The specification provision which, by agency admission, overstated the agency's minimum needs would create a material specification ambiguity if interpreted as suggested by the agency. No recommendation that the ensuing contract be terminated for the convenience of the Government was made in the absence of prejudice to any parties and due to the substantial increased costs that would be incurred if the requirement were resolicited.
