A company appealed the denial of its claim for rental charges for equipment and maintenance at a defunct facility. The claim for rental charges may be allowed because the agency's inability to determine whether the claim had merit was due to its repeated failure to respond to the claimant's requests for payments. The claimant did not make timely demands for payment of the rest of the claim; that portion of the claim must be denied.
