A company protested award of a contract on the basis that the awardee did not meet Interstate Commerce Commission (ICC) requirements to perform the contract. The question of a company's ability to perform involves a determination of responsibility which is not for consideration by GAO. The awardee was the agent of a licensed carrier and was not required to possess ICC authority in its own name. A protest concerning estimated requirements for evaluation was not considered because it was untimely filed.
