Failure To Acknowledge Amendments May Be Waived as Minor Informality

A company protested a contract award on the grounds that the awardee's bid was nonresponsive because of failure to acknowledge solicitation amendments. Failure to formally acknowledge an amendment which included material changes as well as extension of the bid opening date may be waived as a minor informality since the date on the bid indicated that the bidder was aware of the amendment. Failure to acknowledge an amendment which represented a low percentage of the bid prices and had no effect on the competitive standing of bidders may likewise be waived.
