Waiver of Failure To Acknowledge Amendment

A company protested the contracting officer's determination that its bid was not responsive for failure to acknowledge receipt of an amendment, contending that the amendment had no effect on its bid. Since the amendment did not materially affect price, quality, quantity, delivery, or affect the legal relationship between parties, failure to acknowledge the amendment may be waived as a minor informality or irregularity.
