Availability of Appropriations for Employees' Union Dues

A decision was requested regarding the availability of appropriated funds to pay union dues which the agency failed to withhold from employees' salaries. The Secretary of Labor must institute action to recover the resulting overpayments of salary unless he waives such collection. Either the amounts collected or, if waived, the equivalent sum should then be repaid to the union. Appropriated funds may not be used to repay the union without either collecting the amounts owed or waiving the collection.
