Administrative Cost Limitations of the Summer Food Service Program

Lewis B. Strauss, Administrator of the Food and Nutrition Service, asked whether State administrative expense funds authorized by section 7 of the Child Nutrition Act of 1966 might be used to supplement the 2 percent administrative expense payments to States for use in the summer food service program for children authorized by section 13 of the National School Lunch Act, as amended. A prior decision holding that legislation which required payment in an amount equal to 2 percent of funds distributed to each State limits the amount payable to States for costs incurred in administration of the summer food program was reaffirmed.
