Request for Reinstatement of Cancelled Contract

A contractor whose contract was canceled because of a bid error sought to have the contract reinstated so that it could pursue a termination for convenience expense claim. The contract, which was canceled upon the request of the contractor several months after the contracting officer and the contractor knew of the error, should not be reinstated in spite of the principle that a party wishing to rescind a contract on grounds of mistake must announce its intention at once or be bound by the contract. The contractor chose to seek cancellation and raised the issue of improper cancellation only after cancellation was granted and its claim for costs was denied.
