Highlights

A decision was requested as to whether a claim by an employee for overtime compensation during periods when the employee was on military leave and on court leave could be paid. In order for overtime work to be compensable for a civilian employee on military or court leave, the overtime work must have been regularly scheduled and the employee would have been required to perform the overtime duty during the period involved. The employee, absent on military and court leave, was not entitled to overtime compensation since he would not have worked overtime in his work unit had he not been on such leave.
