This document concerns Section 201 of the Flood Control Act of 1965 regarding President Johnson's decision to not obey the provision directing the submission of the projects to the Public Works Committee of Congress for approval and that, in effect, appears to be attempting an item veto. It was found that GAO does not consider it their prerogative or duty to question the constitutionality of laws enacted by the Congress. Until the courts have held a particular act or section of an act unconstitutional, GAO will then deem it their duty to apply the laws accordingly to the intent of the Congress leaving to the courts the question of passing upon the constitutionality of a statue where question of its constitutionality is appropriately raised.
