TO THE HONORABLE BERNARD L. BOUTIN, ADMINISTRATOR, GENERAL SERVICES ADMINISTRATION:

REFERENCE IS MADE TO YOUR LETTER OF OCTOBER 9, 1964, CONCERNING OUR DECISION OF AUGUST 22, 1963, B-151847, APPROVING, ON A TRIAL BASIS, YOUR PROPOSAL THAT BIDDERS ON CERTAIN CONSTRUCTION PROJECTS BE REQUIRED TO SUBMIT WITH THEIR BIDS A LIST OF THE SUBCONTRACTORS WHO WOULD BE USED IN THE PERFORMANCE OF THE WORK.

YOUR LETTER SUMMARIZES THE RESULTS OF THE TEST PROGRAM AND STATES THAT YOU PROPOSE TO BROADEN THE PROGRAM TO INCLUDE ALL GSA PROJECTS ESTIMATED TO COST IN EXCESS OF $150,000, AND THAT THE LISTINGS OF THE CATEGORIES OF WORK WOULD INCLUDE PLUMBING, HEATING, AIR CONDITIONING, ELECTRICAL, ELEVATORS, AND ALL OTHER GENERAL CONSTRUCTION CATEGORIES, THE VALUE OF WHICH YOU ESTIMATE TO BE AT LEAST 3 1/2 PERCENT OR MORE OF THE TOTAL ESTIMATED VALUE OF THE PROJECT. IN ADDITION, FOLLOWING THE PRACTICE SAID TO HAVE BEEN SUCCESSFULLY EMPLOYED BY PURDUE UNIVERSITY, ALL BIDDERS WOULD BE REQUIRED TO SUBMIT THEIR LISTS OF PROPOSED SUBCONTRACTORS WITHIN 48 HOURS AFTER THE TIME SET FOR RECEIPT OF BIDS, AT WHICH TIME THE BIDS AND MATCHING LISTS WOULD BE OPENED.

WHILE WE DO NOT HAVE SUFFICIENT INFORMATION ON WHICH TO BASE AN INDEPENDENT DETERMINATION AS TO THE NECESSITY FOR, AND DESIRABILITY OF, ADOPTING THE PURDUE PLAN, WE SEE NO LEGAL OBJECTION TO THE PROPOSED ACTION, SUBJECT TO THE PROMULGATION OF SUCH REGULATIONS AS MAY BE NECESSARY AND PROPER TO ADEQUATELY PROTECT THE INTERESTS OF THE GOVERNMENT AND THE INTEGRITY OF THE COMPETITIVE BID SYSTEM.
