TO THE SECRETARY OF THE NAVY: FURTHER REFERENCE IS MADE TO YOUR DEPARTMENT'S REPORT OF MAY 4. THERE WAS ENCLOSED A COPY OF OUR DECISION OF THE SAME DATE TO MANHATTAN HOLDING THAT THERE APPEARED NO PROPER BASIS FOR OBJECTION BY OUR OFFICE TO THE ACTION OF THE ADMINISTRATIVE OFFICE IN REJECTING THE BIDS. THERE WAS FURNISHED TO MANHATTAN. THERE NOW HAVE BEEN RECEIVED FROM MANHATTAN LETTERS DATED AUGUST 2. WE HAVE RECEIVED NUMEROUS SUCH COMPLAINTS FROM MANHATTAN. FROM MANHATTAN ARE TRANSMITTED HEREWITH AND IT IS REQUESTED THAT. WHEN DELIVERY UNDER CERTAIN AWARDS MADE TO THEM DURING THE YEAR 1960 BY GENERAL STORES SUPPLY OFFICE WERE AHEAD OF SCHEDULE.

FURTHER REFERENCE IS MADE TO YOUR DEPARTMENT'S REPORT OF MAY 4, 1960, RELATIVE TO THE PROTEST OF MANHATTAN LIGHTING EQUIPMENT CO., INC., 16 WARREN STREET, NEW YORK 7, NEW YORK (HEREINAFTER REFERRED TO AS MANHATTAN), AGAINST THE REJECTION OF ITS BIDS UNDER INVITATIONS NOS. IFB- 155-/1-3/-1488-60 AND IFB-155-/1-3/-1449-60 ISSUED BY THE GENERAL STORES SUPPLY OFFICE, PHILADELPHIA, PENNSYLVANIA.

WITH OUR LETTER TO YOU DATED MAY 20, 1960, THERE WAS ENCLOSED A COPY OF OUR DECISION OF THE SAME DATE TO MANHATTAN HOLDING THAT THERE APPEARED NO PROPER BASIS FOR OBJECTION BY OUR OFFICE TO THE ACTION OF THE ADMINISTRATIVE OFFICE IN REJECTING THE BIDS. SUBSEQUENTLY, THERE WAS FURNISHED TO MANHATTAN, AT ITS REQUEST, A LIST OF THE ARMY, NAVY AND AIR FORCE CONTRACTS REFERRED TO IN OUR DECISION OF MAY 20, 1960.

THERE NOW HAVE BEEN RECEIVED FROM MANHATTAN LETTERS DATED AUGUST 2, AUGUST 5 AND AUGUST 13, 1960, WITH ENCLOSURES, COMMENTING UPON EACH OF THE LISTED CONTRACTS AND CHARGING UNFAIR TREATMENT BY THE GENERAL STORES SUPPLY OFFICE. WE HAVE RECEIVED NUMEROUS SUCH COMPLAINTS FROM MANHATTAN. IN ORDER TO CLARIFY THE SITUATION AND IN THE HOPE OF DISPOSING OF THE MATTER WITH REASONABLE FINALITY, THE LETTERS OF AUGUST 2, AUGUST 5 AND AUGUST 13, 1960, AND THEIR ENCLOSURES, FROM MANHATTAN ARE TRANSMITTED HEREWITH AND IT IS REQUESTED THAT, WITH THE RETURN OF THE ENCLOSURES, OUR OFFICE BE FURNISHED THE VIEWS OF YOUR DEPARTMENT RELATIVE TO THEIR CONTENTIONS, ESPECIALLY AS TO (1) THE ALLEGED MINOR NATURE OF THE DELINQUENT DELIVERIES ON THE BASIS OF WHICH THE GENERAL STORES SUPPLY OFFICE HAS DETERMINED THE COMPANY TO BE A NONRESPONSIBLE CONTRACTOR; (2) THE ALLEGED IMPROPRIETY OF DENYING THEM AWARDS ON THE BASIS OF DELINQUENT DELIVERIES UNDER CONTRACTS WITH OTHER MILITARY AGENCIES BUT WHICH AGENCIES STILL CONTINUE TO GIVE THEM AWARDS; AND (3) THE ALLEGED IMPROPRIETY OF DENYING THEM AWARDS ON THE BASIS OF UNTIMELY DELIVERIES IN 1958 AND 1959, WHEN DELIVERY UNDER CERTAIN AWARDS MADE TO THEM DURING THE YEAR 1960 BY GENERAL STORES SUPPLY OFFICE WERE AHEAD OF SCHEDULE.
