Highlights

An employee appealed a settlement disallowing his claim for overtime compensation for 30 minutes per day since he was not scheduled a lunch break and was allegedly on call during lunch. Even assuming that the employee was on call during lunch breaks, there is no entitlement for overtime compensation for merely being on call. The employee also claimed overtime compensation for working 10 straight days. Only 5 days' work was performed in a single administrative workweek, and the employee is not entitled to overtime for working 40 hours per week.
