B-129726, DEC. 13, 1956

TO MAJOR H. L. KNOPES, USMC, DISBURSING OFFICER, DEPARTMENT OF THE NAVY:

UNDER DATE OF NOVEMBER 5, 1956, THE JUDGE ADVOCATE GENERAL, DEPARTMENT OF THE NAVY, FORWARDED YOUR LETTER OF OCTOBER 6, 1956, SUBMITTING FOR ADVANCE DECISION TRAVEL VOUCHERS IN THE CASES OF LCDR RICHARD A. MCMILLAN, 351786/1317, USNR-R, AND ADC ANDREW L. RACKSTRAW, 268 76 66, USNR-R, COVERING PER DIEM ALLOWANCES WHILE SERVING ON TEMPORARY ADDITIONAL DUTY.

DECISION B-128306, DATED AUGUST 23, 1956, CITED BY YOU, WHICH DENIED PAYMENT OF PER DIEM UNDER AUTHORITY OF PARAGRAPH 4201-6, CHANGE 19, DATED JANUARY 1, 1954, JOINT TRAVEL REGULATIONS, CONCERNED MARINE CORPS ORDERS DATED JUNE 2, 1955, DIRECTING TEMPORARY ADDITIONAL DUTY AT CAMP JOSEPH H. PENDLETON,"IN CONNECTION WITH ANNUAL FIELD TRAINING OF THE MARINE CORPS RESERVE.' PARAGRAPH 4201-6, JOINT TRAVEL REGULATIONS, WAS SUBSEQUENTLY AMENDED BY CHANGE 41, DATED DECEMBER 1, 1955, TO PROVIDE THAT THE LIMITATION THEREIN ON PAYMENT OF PER DIEM SHALL NOT APPLY WHEN PARTICIPATION IN THE TYPES OF DUTY SPECIFIED INVOLVES TEMPORARY DUTY ON AN INSTALLATION OF THE UNIFORMED SERVICES AND PER DIEM IS AUTHORIZED IN ACCORDANCE WITH REGULATIONS ISSUED BY THE SECRETARY OF THE SERVICE CONCERNED.

THE ORDERS OF THE MEMBERS INVOLVED IN YOUR SUBMISSION, ISSUED IN AUGUST 1956 BY THE NAVAL AIR RESERVE TRAINING UNIT, MIAMI, FLORIDA, AUTHORIZED PER DIEM, AND DIRECTED TEMPORARY ADDITIONAL DUTY AT NAVAL AIR STATION, SOUTH WEYMOUTH, MASSACHUSETTS, IN CONNECTION WITH TRAINING. THE COMMANDING OFFICER, NAVAL AIR RESERVE TRAINING UNIT, MIAMI, FLORIDA, HAS REPORTED THAT THE FUNCTION OF PERSONNEL OF HIS UNIT ON AN ACTIVE TRAINING CRUISE IS THAT OF PROVIDING QUALIFIED ASSISTANTS, AS NEEDED, AND INSTRUCTION TO PERSONNEL UNDERGOING TRAINING. THUS, IT APPEARS THAT THE DUTY PERFORMED IN THE SUBMITTED CASES FALLS WITHIN THE EXCEPTION TO THE PROHIBITION IN PARAGRAPH 4201 6 (CHANGE 41), JOINT TRAVEL REGULATIONS, AGAINST PAYMENT OF PER DIEM. ACCORDINGLY, PAYMENT ON THE SUBMITTED VOUCHERS--- WHICH TOGETHER WITH SUPPORTING PAPERS ARE RETURNED HEREWITH--- IS AUTHORIZED, IF OTHERWISE CORRECT.
